Photography Agreement

This agreement is entered into between Maiden's Moments Photography ("Photographer" or "I") and the client ("Client" or "you"). By booking with Maiden's Moments Photography, you agree to the following terms:
I. Booking and Payment
Ia. Weddings:
A non-refundable deposit of 25% of the booking total is required to secure your wedding date. The remaining balance is due 4 weeks before the scheduled wedding day. If the remaining balance is not received by this time, the booking may be cancelled at my discretion.
Ib: All Other Sessions:
Full payment is required a week before the booked session date (i.e., if a session is scheduled for June 14, payment is due by June 7). No deposit is required.
II. Cancellations and Rescheduling
IIa: Client Cancellations and Rescheduling
In the event Client needs to reschedule, please notify Photographer at least 3 days in advance. If a session is re-scheduled more than once, a fee will apply, being 25% of the session price. If Client wishes to cancel the session, any and all deposits or payments are non-refundable.
IIb: Photographer Cancellations and Rescheduling
In the event that Photographer needs to reschedule, suitable efforts will be provided to agree on a rescheduled date. If the session cannot be rescheduled due to consistent scheduling conflicts, all payments will be refunded.
IIc: Weather/Uncontrollable Cancellations and Rescheduling
In the event the weather makes it necessary to reschedule the session, Photographer will promptly communicate with Client to schedule a day that works for both parties. No additional fees will be added onto the session due to this. If the session cannot be rescheduled due to consistent scheduling conflicts, all payments will be refunded.
III. Sessions Details
Client is responsible for arriving on time and being prepared. Delays may reduce the shooting time or lead to a rescheduled date. If the shoot is rescheduled due to Client being late, a fee of 25% of the session price will apply. Additional time is not guaranteed if the session is delayed.
IV. Image Delivery
IVa: Edited Photos
Edited, high-resolution images will be delivered within the communicated time Photographer provides to Client. Photographer will select the best photos from the session to edit - a "required photo list" will be accepted and considered, but not guaranteed. Once Client has received the images, Client must take the link provided, navigate to the Gallery tab on the website and paste the link to receive the images.
IVb: Raw Photos
Raw, unedited photos will not be provided, nor available to purchase. Photographer will select the best photos from the session to edit.
IVc: Additional Photos to Purchase
If applicable and at Photographer's discretion, Photographer will edit additional photos that will be made available to Client to purchase. This is not a guarantee.
V. Artistic/Editing Style
By booking with Photographer, Client acknowledges familiarity with Photographer's editing style and agrees to allow full creative freedom during the session and final edits. No re-edits or refunds will be provided solely based on Client's style or editing preferences.
VI. Image Use, Copyright and Editing
All images remain the copyright of Photographer. Client receives a personal-use license for sharing and printing. Client may not alter or otherwise heavily edit the final images in any way. Commercial use, resale, or editing without prior permission is prohibited.
VII. Model Release
By booking, Client grants Photographer the right to use images from Client's session for promotional purposes (e.g., website, portfolio, social media, etc.).
VIII. Limitation of Liability
Every effort will be made to deliver high-quality images. In the unlikely event of technical failure, injury, or unforeseen circumstances, liability is limited to a free reschedule of the session. If unapplicable, a full refund of payments will be made. No further liability is accepted.
IX. Amendments
Any terms of this agreement may be altered or modified at the discretion of both parties through mutual agreement, communication and written consent.
